Mr S, a UK expat living in South Africa, contacted Seth Lovis & Co to advise him on an asbestos-related disease claim after he was diagnosed with mesothelioma, a rare and extremely aggressive type of asbestos-related cancer. Alan Gore, a senior litigation executive in the industrial disease team at Seth Lovis & Co, was able to successfully pursue a claim for compensation against the man's former employers in the UK, Tate & Lyle, even though he was living in South Africa at the time of his claim.
Mr S had worked as a general apprentice for Tate & Lyle in East London for five years between 1965 and 1970.
As a general apprentice he spent six months in several different departments learning several different trades, including the pipe fitting department and the electrical department.
During the course of his apprenticeship Mr S helped plumbers lag boilers and other pipes with asbestos, which was used due to its heat insulating properties.
Exposure to asbestos dust
Mr S was regularly exposed to airborne asbestos dust without being provided with any breathing protection, nor was he given any warnings about the dangers of his unprotected asbestos exposure by his employers.
Mr S moved to South Africa in 1970 and was worried that this may affect his case, however Alan was able to prove the clients exposure to asbestos in the UK, at Tate & Lyle.
Due to the client's decreased life expectancy, Alan was able to secure £160k in compensation, just six months after the initial instructions. Alan was also able to claim Industrial Disease Disablement Benefit from UK government, on his behalf.
Alan Gore, a senior litigation executive in the industrial disease department at Seth Lovis & Co Solicitors in London states, "Even though Mr S had not lived in the UK for over 40 years, we were still able to successfully prove his exposure to asbestos here, so it did not matter that he was living in South Africa at the time of his claim. I was delighted for him and for his family, as mesothelioma is such a terrible condition. I hope that the compensation payment will go some way to securing his families future."
