Angela Richards, a personal injury Solicitor at Seth Lovis & Co, recently acted for Mr W who sustained a serious back injury at work. Angela was the right solicitor to act for the client because she has considerable experience in handling personal injury claims involving serious back injury at work claims.
At the time of the accident, Mr W was employed as an office based administrative assistant for a commercial bakery. Upon commencing his employment with the Defendant company, he had informed them that he had back trouble and shouldn’t do any manual handling. Manual handling was not part of his job description in any event.
On the day of the accident, the bakery’s warehouse was short staffed so he was asked by his manager to help move pallets of frozen pasties from the factory floor to the industrial freezers. This stock transfer would normally be carried out using a small electric pallet truck, but there were not any available. Mr W therefore was told to use a manual pallet truck. Mr W had to load the manual pallet truck with 48 boxes of frozen pasties, and pull the pallet up a sloped ramp into a freezer. As he was doing so, he suffered an injury to his back.
Prolapsed Disc Injury at Work
Mr W suffered a prolapsed disc, was referred to a spinal surgeon and had to undergo a discectomy as well as one further operation to recitify a dural leak.
Medical Experts Opinion
Angela instructed a Consultant Spinal Surgeon to prepare a full medical report regarding Mr W’s back injury. The expert was of the opinion that the accident was the final causative event which lead to Mr W’s back injury, but that Mr W was likely to have suffered similar symptoms within 2 years of the accident date, even if the accident hadn’t have happened.
Defendants Denied Liability
Mr S’s employers initially denied liability for the accident and maintained their denial for 3 years. Angela issued court proceedings against them, which resulted in them quickly settling the case before trial. Mr W was awarded £14,000 in compensation, for his injuries and financial losses arising from the accident.
